Filming on public land - application form

This application is for filming and large scale still photography on Council-owned property, in open spaces and outdoor areas such as footpaths, roads and parks within the Queanbeyan-Palerang Regional Council local government area. Please ensure that you have read the Department of Local Government's Local Government Filming Protocol as these outline the broad requirements for filming within NSW. The Protocol can be found on the Department's website at  www.olg.nsw.gov.au.

Once you have completed this application you will receive a letter outlining the specific conditions Queanbeyan-Palerang Regional Council will be applying to your filming proposal. In order to speed up your application it is important that the information in this application is full and accurate. Any inaccuracies may lead to the cancellation of an approval at any time.

On submission of this application form the applicant must pay the relevant application fee outlined by Council. Payment methods include credit card, cheque or cash (in person at Council's Customer Service Centre). General Film and Photography Conditions

All Production personnel must comply with all approval conditions.

  • The Production Company and all production personnel must comply with any safety, regulatory or compliance directive of the Council’s officers.

  • The Production Company must indemnify the Council against all claims for damage or injury that may result from either the activities or from the occupation of part of the public land during the activities.  The liability of the Production Company to indemnify Council will be reduced proportionally to the extent that a negligent act or omission of Council (as the statutory authority in respect of the relevant road reserve area) has contributed to the damage or injury.  Documentary evidence of public liability insurance cover (under which Council is indemnified) with a minimum policy value of at least $10,000,000 must therefore be produced. (Receipt of documentary evidence of such insurance cover is noted).

  • Any activities associated with the filming approval shall not be undertaken near any residentially occupied premises between 10.00 pm and 7.00 am on any day unless specific approval has been granted.

  • The Production Company must ensure that the activities are undertaken without unduly disrupting stakeholders, pedestrians and/or motorists in the vicinity of the location, by at all times ensuring the right of unrestricted access and by maintaining a safe and clear footway for public use.

  • The Production Company must ensure that any lighting be directed away from motorists and from nearby residences.

  • The applicant shall reimburse Council (or other agency as appropriate) for the cost of repair of any damage caused to the public way during, or as a result of, the filming activities.

  • Equipment used and all activities associated with filming shall comply with the Protection of the Environment Operations Act 1997, and any noise generated by the activities shall not increase the indoor background sound pressure level prior to 10.00 pm by more than 5dBA, or lead to any increase from 10.00 pm – 8.00 am the following day, unless specific approval to do so has been obtained from Council.

  • The Production Company must ensure that any traffic control to be undertaken in conjunction with the activities shall be undertaken by Police and/or RTA accredited traffic controllers, shall be of maximum duration of three minutes at any one time, shall comply with all relevant Workcover and industry safety standards, and shall give priority access to local residents and stakeholders.

  • The Production Company shall ensure that the areas to be used for the activities shall be maintained in a clean and tidy condition to the satisfaction of Council, with all waste materials associated with the activities bagged and removed from the site by Production representatives, and with costs involved for any extraordinary cleaning subsequently required to be undertaken by Council to be borne by the applicant.

  • The Production Company shall ensure that it has in place a Workplace Health and Safety Plan that covers all production Company personnel during the activities, with the Plan being to the requirements and satisfaction of Workcover NSW.

  • The Production Company must ensure that all parked vehicles associated with the production are to be legally parked at all times.

  • The Production Company must ensure that the use of any private property, for either the conduct of the activities or for equipment storage, shall not occur unless the prior approval of the property owner is obtained.

  • The Production Company must ensure that an appropriately accredited film industry Safety Officer is engaged and on-site for the activities, with responsibilities being the maintenance of public safety at all times during the conduct of the activities, the barricading and clear delineation of both the work site and any associated equipment compounds, and, with the exception of the work areas, the maintenance of safe and clear public footways around the site at all times.

  • The Production Company shall be subject to a further 75% of the application fee should alterations to an issued filming permit subsequently be requested.

  • Council reserves the right to amend or cancel this approval at any time.
